Health Island Four Pillars Why VitaMed Partner access

General Terms and Conditions for Health and Wellbeing Travel Programmes

Status: October 2026

1. Organiser and Scope

The organiser and contracting party of the travel programmes offered under the brand VitaMed Mallorca is German Medical Services S.L.U. (hereinafter “VitaMed”), a wholly owned subsidiary of Policlínica Alemana S.A. The full company name, registered office, tax ID, tour operator registration number and details of the insolvency protection are to be added before publication. These terms apply to the programmes expressly designated as travel services in the respective offer. Mandatory statutory rights remain unaffected.

2. Conclusion of Contract and Pre-Contractual Information

The individual programme description, the offer, the booking confirmation and the statutory information provided before the contract is concluded, including the relevant standard information form for package travel, are decisive. The contract is concluded when VitaMed accepts the booking. Deviating individual agreements take precedence.

3. Scope of Services and Service Partners

The agreed travel services may include, in particular, accommodation, transfers, leisure and wellbeing offers, and medical services. Accommodation, transfers and other components are partly provided by independent service partners. Medical services are provided by Policlínica Alemana S.A. under the brands DFZ / MEDICUM Mallorca. The engagement of third parties does not affect VitaMed’s mandatory statutory responsibilities as the tour operator. Services not expressly listed are not included in the travel price.

4. Prices and Payment

The total price and the services included are set out in the binding offer. A deposit of 30% after booking confirmation and payment of the balance no later than 21 days before the start of the trip are proposed; for short-notice bookings, the total price becomes due. Payment requests, and in particular deposits, are subject to the insolvency protection required by law in each case and to proper information about it. Individual medical services may be itemised or invoiced separately; this does not affect the legal classification of the overall offer booked.

5. Withdrawal by Travellers and Cancellation Costs

Travellers may withdraw from the package travel contract at any time before the start of the trip. Where legally permissible, VitaMed may demand reasonable compensation. The following provisional flat-rate scale is envisaged: up to and including 29 days before the start of the trip 20%, 28 to 15 days 30%, 14 to 8 days 50%, from 7 days 90% of the relevant travel price. The reasonableness of these flat rates must be demonstrated on the basis of expected cost savings and alternative use of the travel services, and must be legally reviewed before use. Travellers may, where applicable, prove that a lower compensation is due. Statutory rights of withdrawal free of charge, in particular in the event of unavoidable, extraordinary circumstances at the destination, remain unaffected. Notices of withdrawal should be given in text form.

6. Rebooking, Substitute Travellers and Unused Services

Requests for changes are examined subject to availability; any permissible additional costs will be communicated before consent is given. The statutory transfer of the contract to a substitute person remains unaffected. If individual services are not used for personal reasons or the trip is ended early, refunds are governed by the statutory provisions, including saved expenses and possible alternative use; a blanket exclusion of any refund has not been agreed.

7. Minimum Number of Participants and Changes

A minimum number of participants applies only if it is expressly stated in the specific programme description and booking confirmation. Cancellation due to failure to reach it takes place only within the statutory deadlines; for trips of more than six days, in principle no later than 20 days before the start. Insignificant changes permitted by law will be communicated in good time. In the event of significant changes, the statutory rights of choice, withdrawal and refund apply. In the event of unavoidable, extraordinary circumstances, the special statutory provisions apply.

8. Medical Services and Participation

Medical examination, information, determination of indication and treatment are carried out under their own responsibility by the treating medical professionals of Policlínica Alemana S.A. No particular diagnosis, therapy or treatment outcome is guaranteed. Medical measures are carried out only after professional assessment and the required consent. Participants should provide the treatment team with truthful information on relevant health matters. Treatments that are not medically suitable may be omitted or adapted following a medical assessment; any resulting claims will be assessed under the respective contract and mandatory law.

9. Liability, Notice of Defects and Remedy

VitaMed is liable for the proper provision of the package travel services owed under the contract in accordance with mandatory statutory provisions, including where services are provided by third parties. The professional medical responsibility of the respective practitioners and their own statutory liability remain unaffected. Limitations of liability that are not permitted by law, in particular for personal injury or for damage caused intentionally or negligently, are not agreed. Travellers are asked to report any defects in the travel services without delay via the contact point named in the travel documents so that remedy can be provided.

10. Travel Documents, Insurance and Data Protection

Hotel check-in and check-out as well as transfer times are set out in the travel documents. Travel cancellation, international health and repatriation insurance are recommended where not included. Personal data is processed in accordance with a separate privacy policy; health data is processed within the medical treatment relationship under the special protection requirements applicable to it.

11. Insolvency Protection, Applicable Law and Consumer Rights

According to the organiser, German Medical Services S.L.U. holds a tour operator registration and insolvency protection. The registration number, insurer or security provider, contact details and any mandatory notices will be inserted before publication. Mandatory provisions of Spanish and European package travel law as well as applicable consumer protection regulations take precedence. A jurisdiction or choice-of-law clause may not restrict statutory consumer rights.
